Visa Cancellation

Options After Visa Has Been Cancelled

If your visa has been cancelled you would have received a cancellation notice that contains the reasons for your cancellation along with your rights to review.

Visa is Cancelled Now What to Do?

Act Fast and Consider all Options.

It is never a good thing when your visa has been cancelled.

We have witnessed multiple clients who come into our office and are shell shocked to know that their visa has been cancelled. A visa may be cancelled due to multiple and various grounds. But now that it has happened you will need to study your case and act fast.

Your visa cancellation notice will contain the reasoning of your non-compliance and/or the grounds of cancellation. The visa cancellation notice will also provide your rights to review.

As such, you will have an option to appeal to the Administrative Appeals Tribunal (AAT), within a strict time

We at Fast Migration Australia will study your case thoroughly and without any bias advise of your reasonable prospects of success if we were to appeal.  We are completely honest and have built up our respect and client base with pure transparency.

We can assist you with:

  •     Reviewing case to advise on prospects of appeal;

  •     Advise on other immigration options – separate or parallel to an appeal or review;

  •     Preparing all aspects of the appeal, including written submissions to the Tribunal;

  •     Preparing the case and client for the Tribunal hearing;

  •     Preparing and collecting evidence to support the case; and

  •     Representing and advocating for clients at the hearing.

We will ensure that we put forward strong written submissions, collating relevant and appropriate evidence, and identifying relevant legislation from the Migration Act (1958) and Migration Regulations (1994) in your appeal of cancellation.

Can I Stay in Australia?

Act Fast and Consider all Options.

If you do not appeal the visa cancellation, then you will have to depart and leave Australia generally within 35 days from the day you had received the cancellation letter.

If you stay in Australia after 35 days from the cancellation and have not appealed to the AAT then you will be deemed to be overstaying your visa, and considered illegal.

If you have appealed for your visa cancellation generally within 28 days from the date of cancellation then you can apply for a Bridging Visa to stay in Australia during the appeals process of your cancellation.
